Terms of Service
By adding Vibe to a Discord server, or by using any Vibe command or feature, you agree to these terms. If you do not agree, remove the bot and stop using it.
1. What Vibe is
Vibe is a Discord application that plays audio in voice channels, keeps a shared queue, and records listening statistics. It is operated as a personal project and provided as-is. "Vibe" includes every bot instance published under that name (Vibe, Vibe 2, Vibe 3 and Vibe Beta) and the in-Discord Activity.
Playing music is free and stays free. What Vibe plays, the services it plays from, and how it sounds are not sold and are the same for everybody. An optional paid subscription is offered for features Vibe itself provides — how it looks, what it remembers for you, and how much of it you can keep. Section 6 covers those, and applies only if you buy one.
2. Who may use it
You must meet Discord's minimum age requirement for your country and comply with the Discord Terms of Service and Community Guidelines. Those terms govern your use of Discord itself and take precedence over these where the two overlap.
3. Acceptable use
You may not use Vibe:
- to break the law, or to infringe anyone's rights;
- to harass, abuse or harm anyone;
- to distribute malicious, deceptive or illegal content;
- to attempt to disrupt, overload, probe, reverse engineer, or gain unauthorised access to Vibe or the systems it runs on;
- with automation that issues commands at a rate a person could not.
4. Content and third-party services
Vibe locates and streams audio from third-party services. It does not host, store, sell, or distribute recordings, and it provides no means of downloading them. All rights in that content belong to their respective owners. Vibe is not affiliated with, endorsed by, or sponsored by Discord Inc. or by any content provider. Your use of those services remains subject to their own terms.
5. Availability
Vibe is a hobby project running on modest hardware. It may be unavailable, interrupted, changed or shut down at any time, without notice. No uptime is promised, and features may be added, changed or removed.
6. Paid subscriptions
Vibe offers optional paid subscriptions. This section states the terms that apply to them, and applies only if you buy one.
Discord sells it, not us. Any Vibe subscription is an application subscription purchased inside Discord. Discord is the seller and handles the payment, the receipt, the renewal and the cancellation; we never see your payment details. Your purchase is therefore also governed by Discord’s own Terms of Service and Refund Policy, which take precedence over this section where the two overlap.
Price, renewal and cancellation. The price and billing period are shown in Discord before you confirm, and that is the price that applies. A subscription renews automatically each period until you cancel it, which you do in Discord’s own subscription settings. Cancelling stops the next renewal; it does not end the period you have already paid for, and paid features keep working until that period ends. If the price changes, the new price applies to new subscriptions — an existing subscription keeps its price until it is cancelled.
Refunds. Because Discord takes the payment, refunds are handled by Discord under its refund policy. We cannot issue, approve or refuse one.
If you are a consumer in the EU or EEA you normally have 14 days to withdraw from a purchase of digital content. That right is lost once supply of the content begins with your express consent and your acknowledgement that you lose it — which is what Discord asks you to confirm at the moment of purchase, since paid features unlock immediately. Nothing here removes any mandatory consumer right you have under the law of your country of residence.
What a subscription does and does not include. It applies to your Discord account across every server and every Vibe instance, or — for the server subscription — to the one server you choose to back with it, for everyone in that server. Vibe Solo is the personal one, Vibe Room is the server one, and Vibe Encore is both. It never changes what can be played, which services it is played from, how much of it you can play, or the audio quality: those are free for everybody and are not part of any paid tier. Paid features may be added, changed or removed under section 5; if a feature you are paying for is removed materially, it will be announced in the support server before it takes effect.
If your subscription ends, anything you created with it stays yours to read, export and delete — see the Privacy Policy. Paid features simply stop being available.
Backing a server. A subscription that includes a server (Vibe Room, or Vibe Encore) belongs to the member who takes it out, and backs one server at a time: you choose it with /premium in a server where you have the Manage Server permission, and a server already backed by another member’s subscription cannot be backed by a second one. Once chosen, it stays on that server for seven days before it can back a different one. It stops backing a server when the subscription ends, when you stop it yourself, or when you leave that server; leaving does not shorten the seven days. Nobody else can move or stop it.
If a server’s subscription ends, its playlists are kept. They stay readable, and a server manager can still delete them, but they cannot be played, edited or renamed until a member backs the server again. The one exception is the server’s oldest playlist, which stays usable within the limits every server has without a subscription; if it grew beyond them while the server was subscribed, nothing is removed, but only the first part of it plays.
7. Your server’s data
Settings you configure are stored so the bot can function. See the Privacy Policy for exactly what is kept. Server administrators are responsible for how their members use Vibe within their server, and for the permissions they grant it.
8. Suspension
Access may be withdrawn from any user or server that breaks these terms, abuses the service, or puts it at risk, at our discretion and without prior notice.
9. No warranty
Vibe is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, arising from your use of or inability to use Vibe. Nothing in these terms limits liability that cannot lawfully be limited or excluded.
11. Changes
These terms may change. Material changes will be announced in the support server before they take effect. Continuing to use Vibe after a change means you accept it.
12. Contact and governing law
Questions about these terms: the Vibe support server. These terms are governed by the laws of Spain, without regard to conflict-of-law rules. Where you are a consumer, this does not deprive you of the protection of the mandatory consumer-law provisions of your country of residence.
